Starting December 2, 2024, Immigration New Zealand (INZ) is introducing significant changes to make open work rights available to more partners of migrant workers.
This initiative not only supports family unity but also addresses skill and labor shortages in key sectors across New Zealand.
What Does This Mean for You?
Open work rights allow partners of migrant workers to work for any employer, providing greater flexibility and opportunity for families settling in New Zealand. The changes aim to make New Zealand a more attractive destination for skilled workers and their families, ensuring businesses have access to the talent they need.
Who is Eligible for Open Work Rights?
From December 2, 2024, open work rights will be available to:
1. Partners of Accredited Employer Work Visa (AEWV) Holders
Working in ANZSCO Level 1-3 roles earning at least $25.29 per hour (80% of the standard median wage).
Already supporting a partner for a work visa on June 26, 2024, and earning at least $25.29 per hour.
2. Partners of Essential Skills Work Visa Holders
Earning at least $25.29 per hour.
3. Partners of AEWV Holders in ANZSCO Level 4-5 Roles
Earning at least $47.41 per hour (150% of the standard median wage).
Earning at least $31.61 per hour in a Green List role and meeting Green List requirements.
Earning at least $25.29 per hour (or the specified sector agreement wage, whichever is higher) in Transport or Care Sector Agreement roles.
What is ANZSCO?
ANZSCO, or the Australian and New Zealand Standard Classification of Occupations, grades occupations by skill level, ranging from Level 1 (most skilled) to Level 5 (less skilled). This system helps determine eligibility for open work rights based on skill and wage thresholds.
Transitioning to Open Work Rights
If you currently hold a partner work visa with specific employment conditions, you may apply to vary your visa conditions to switch to open work rights - provided your partner meets the updated criteria. Applications for variation of conditions or new work visas open on December 2, 2024.
